YARDLEY, PA - The U.S. District Court for the Eastern District of Pennsylvania, with Judge Mitchell S. Goldberg presiding, ruled on December 2, 2013 that Fiber Optic Designs (FOD) has "won" its patent infringement case against Chinese Christmas light manufacturer, Bortex. In granting FOD's motion for case dispositive sanctions, attributable to discovery abuse by Bortex, the court struck Bortex's claims that the FOD patent (7,220,022) was invalid, unenforceable and/or not infringed and decided that it would "enter judgment in favor of FOD". In issuing the opinion, Judge Goldberg pointed out that Bortex's expert witness had acknowledged that at least claim 69 of the ‘022 patent has been infringed by Bortex.
